1. What we do
We are a documentation and filing service. We help you prepare and submit paperwork for legal name changes and related records – affidavits, newspaper notices, Gazette notifications, and updates to identity, education, financial, vehicle and property documents.
2. We are not a law firm
This is important, so we state it plainly. NameChangeDesk is not a law firm and we are not your advocates. Nothing on this site or in our correspondence is legal advice, and engaging us does not create an advocate-client relationship or attract legal professional privilege. Where a matter requires notarisation or legal representation, we coordinate with independent notaries and advocates. If you need advice on your legal position, please consult a qualified advocate.
3. Eligibility
You must be at least 18 years old to instruct us on your own behalf. Applications for a minor must be made by a parent or lawful guardian, who accepts these Terms on the minoru2019s behalf and must be able to demonstrate their authority to act.
4. Your responsibilities
The quality of our work depends entirely on what you give us. You agree that:
- All information and documents you provide are true, accurate, complete and your own.
- You will not submit forged, altered or fraudulently obtained documents.
- You will not use our services to evade creditors, escape a criminal investigation, defeat a court order, or otherwise mislead any authority.
- You will respond promptly when we request clarification or additional documents.
We may suspend or terminate an application immediately, without refund, if we have reasonable grounds to believe any of these commitments has been breached, and we may be obliged to report the matter to the relevant authority.
5. Fees and payment
Our fees are quoted before work begins and are payable in advance unless we have agreed otherwise in writing. Government fees, gazette charges, newspaper advertising costs and notary charges are set by third parties, may change without notice, and are payable in addition to our service fee unless your quote expressly says they are included.
6. Refunds and cancellation
If you cancel before we have begun work, we will refund your service fee in full. Once work has started, we will refund the portion of the service fee representing work not yet performed. Amounts already paid to third parties on your behalf – government fees, gazette charges, newspaper advertising, notary fees – cannot be refunded once incurred, as those bodies do not return them to us. Refunds are processed to the original payment method, normally within 7 to 14 working days.
7. Timelines and outcomes
We commit to preparing and filing your paperwork correctly and promptly. We cannot commit to the speed or the outcome of any government process. Gazette publication, RTO processing and passport or Aadhaar updates run on timelines set by the authorities concerned, and any estimate we give is indicative only. Where an application is rejected because of an error on our part, we will correct and refile it at our own cost. Where it is rejected because of inaccurate information you supplied, or a change in government policy or procedure, further work will be chargeable.
8. Intellectual property
The content, design and materials on this site belong to us and may not be copied or reproduced commercially without our written permission. Documents we prepare specifically for your matter are yours to use for that purpose.
9. Limitation of liability
To the extent permitted by law, our total liability arising out of or in connection with any engagement is limited to the service fee you paid us for that engagement. We are not liable for indirect or consequential losses, including loss of profit, opportunity, or the consequences of delay by any government authority. Nothing in these Terms limits liability for fraud or for anything that cannot lawfully be limited.
10. Third-party sites
Our site may link to government portals and other external sites. We do not control them and are not responsible for their content, accuracy or availability.
11. Suspension and termination
You may end your engagement at any time, subject to clause 6. We may end it if you breach these Terms, if you fail to provide documents we need to proceed, or if continuing would require us to act unlawfully or unethically.
12. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at [CITY, STATE] have exclusive jurisdiction over any dispute arising from them.
13. Changes to these Terms
We may revise these Terms from time to time. The version published on this page when you instruct us is the version that applies to your engagement.
